SECTION 1 – ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) govern your access to and use of the NomadMat website, store, products, and services (collectively, the “Services”).

By accessing the Services or purchasing any product, you agree to be legally bound by these Terms and our:

If you do not agree, you must not use the Services.

NomadMat’s store is powered by Shopify. Purchases are made directly with NomadMat.  See more below in Section 14 – Relationship with Shopify.

Because our store is hosted by Shopify, certain personal information may be collected and processed by Shopify in order to provide and improve the Services. Please review our Privacy Policy for details.

SECTION 2 – ELIGIBILITY

You represent that:

  • You represent that you are at least 18 years old or the age of majority in your jurisdiction. If you are under 18, you must have parental or guardian consent to use the Services or purchase products.
  • Any minor using NomadMat products does so under competent adult supervision.
  • All information provided is accurate and complete.

You are responsible for safeguarding account credentials and all activity occurring under your account.

SECTION 3 – PRODUCTS; PERFORMANCE DISCLOSURES

NomadMat designs premium yoga mats, towels, and accessories for personal fitness and lifestyle use.

Product appearance, color, texture, and feel may vary based on screen settings, lighting, material batch variation, and environmental conditions.

NomadMat does not guarantee that product appearance will exactly match on-screen representations.

NomadMat products are designed for general fitness and yoga use. No product is guaranteed to prevent injury, provide specific health benefits, or perform identically under all conditions (e.g., varying sweat levels, temperatures, or surfaces). Descriptions of features such as grip, material composition, or eco-friendly attributes are based on manufacturer testing and are not medical or performance guarantees.

SECTION 4 – ASSUMPTION OF RISK; RELEASE; WAIVER OF LIABILITY

4.1 Inherent Risks of Physical Activity

Yoga, Pilates, stretching, gym exercise, hot yoga, sauna exposure, and all physical activity involve inherent and unavoidable risks, including but not limited to:

  • Slips and falls
  • Loss of balance
  • Joint strain
  • Muscle tears
  • Heat-related illness
  • Dehydration
  • Permanent injury
  • Death

These risks may arise from:

  • Moisture accumulation
  • Sweat saturation
  • Improper mat placement
  • Uneven or unstable flooring or outdoor surfaces
  • Environmental heat or extreme temperatures outside
  • Product wear
  • User error

Such risks cannot be eliminated.

4.2 Voluntary Assumption of Risk

By purchasing or using NomadMat products, you:

  • Acknowledge and understand the inherent risks of physical activity.
  • Voluntarily assume all risks associated with use.
  • Accept full responsibility for safe placement, supervision, and environment.
  • Agree that you are solely responsible for determining whether you are physically capable of participating in any activity.

If you have medical conditions, injuries, or concerns, you should consult a qualified healthcare provider prior to use.

4.3 Express Release of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE NOMADMAT AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, CAUSES OF ACTION, OR LIABILITIES ARISING FROM:

  • PERSONAL INJURY
  • PROPERTY DAMAGE
  • HEAT-RELATED INJURY
  • SLIP INCIDENTS
  • LOSS OF GRIP
  • MATERIAL BREAKDOWN
  • STUDIO OR COMMERCIAL USE
  • THIRD-PARTY USE

THIS RELEASE APPLIES WHETHER THE CLAIM ARISES IN NEGLIGENCE, STRICT LIABILITY, CONTRACT, STATUTE, OR OTHERWISE. THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM NOMADMAT’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

4.4 Commercial Use Allocation of Risk

If NomadMat products are used in:

  • Gyms
  • Yoga studios
  • Retreats
  • Hotels
  • Commercial fitness facilities

in each case, including use by clients, members, guests or other third parties,

The commercial operator assumes responsibility for:

  • Routine inspection
  • Proper placement
  • Safe environment
  • Compliance with local safety standards
  • Maintaining adequate liability insurance

NomadMat disclaims liability for injuries sustained by clients, members, guests or other third parties in commercial environments.

4.5 No Medical or Professional Advice

Information provided through our website, packaging, or marketing materials is for general informational purposes only and does not constitute medical or professional advice. Consult a qualified healthcare provider before engaging in physical activity, especially if you have pre-existing conditions, injuries, or concerns. 

SECTION 5 – ORDERS & ACCEPTANCE; FRAUD AND CHARGEBACK PROTECTION

Submission of an order constitutes an offer to purchase.

NomadMat reserves the right to accept or decline orders at its discretion.

Title and risk of loss transfer as described in our Shipping Policy.

NomadMat reserves the right to refuse, cancel, or limit any order suspected of fraud, unauthorized activity, or violation of these Terms.

If a chargeback is initiated without first contacting NomadMat to attempt resolution, NomadMat reserves the right, where permitted by law, to recover reasonable administrative and processing costs associated with the chargeback.

SECTION 6 – PRICING & PAYMENT

Prices are subject to change without notice.

You represent that:

  • Payment information is accurate.
  • You are authorized to use the payment method.
  • Charges will be honored.

We reserve the right to correct pricing errors and cancel orders if necessary.

SECTION 7 – RESALE PROHIBITION; EXPORT COMPLIANCE

Products are for personal use only.

You may not:

  • Resell
  • Bulk distribute
  • Export commercially
  • Private label
  • Engage in arbitrage resale

We reserve the right to cancel suspected resale orders.

You agree not to export, re-export, or transfer any NomadMat product in violation of U.S. export control laws or regulations.

SECTION 8 – DISCLAIMER OF WARRANTIES; LIMITED PRODUCT WARRANTY

8.1 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN WRITING BY NOMADMAT AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

NOMADMAT DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • FITNESS FOR COMMERCIAL USE
  • DURABILITY
  • NON-INFRINGEMENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

NOMADMAT DOES NOT WARRANT THAT:

  • PRODUCTS WILL PREVENT INJURY.
  • GRIP PERFORMANCE WILL BE UNIFORM UNDER ALL CONDITIONS.
  • PRODUCTS WILL PERFORM IDENTICALLY IN HEATED ENVIRONMENTS.
  • MATERIALS WILL NOT DEGRADE OVER TIME.
  • USE WILL BE UNINTERRUPTED OR FREE FROM DEFECTS.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES; IN SUCH CASES, WARRANTIES ARE LIMITED TO THE MINIMUM DURATION PERMITTED BY LAW.

8.2 Third-Party Services and Tools

The Services may include integrations, applications, or tools provided by third parties, including payment processors, shipping carriers, marketing platforms, analytics providers, and other service providers. These services are provided “as is” and are subject to the terms and policies of the respective third parties. NomadMat is not responsible for the performance, security, or practices of such third-party services.

8.3 Limited Product Warranty

NomadMat warrants its products against manufacturing defects in materials and workmanship under normal personal use for a period of one (1) year from the original date of purchase.
This Limited Warranty:
  • Applies only to the original purchaser.
  • Is non-transferable.
  • Requires valid proof of purchase.
This Limited Warranty does not cover:
  • Normal wear and tear
  • Cosmetic damage
  • Folding stress from regular use
  • Exposure to excessive heat (including prolonged sauna or heated studio use)
  • Improper cleaning or storage
  • Commercial or studio use
  • Accidents, misuse, or alteration
If a manufacturing defect is confirmed, NomadMat will, at its sole discretion, repair or replace the product.

No refunds will be issued under this Limited Warranty.

This Limited Warranty is your sole and exclusive remedy and is consistent with our Returns & Exchange Policy. For items that arrive damaged or defective, please refer to that policy.

To initiate a warranty claim, contact us. NomadMat reserves the right to require return of the product for inspection before issuing any warranty remedy.

SECTION 9 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOMADMAT SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • SPECIAL DAMAGES
  • PUNITIVE DAMAGES
  • LOSS OF PROFITS
  • EMOTIONAL DISTRESS
  • LOSS OF GOODWILL
  • LOSS OF BUSINESS OPPORTUNITY
  • LOSS OF DATA
  • LOSS OF USE
  • COST OF SUBSTITUTE GOODS
  • CHARGEBACK FEES
  • ATTORNEY’S FEES (EXCEPT AS REQUIRED BY APPLICABLE LAW)

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOMADMAT’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THIS LIMITATION APPLIES REGARDLESS OF:

  • LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, STATUTE)
  • FORESEEABILITY OF DAMAGES
  • WHETHER REMEDIES FAIL OF THEIR ESSENTIAL PURPOSE

IN JURISDICTIONS WHERE CERTAIN DAMAGES CANNOT BE LIMITED, LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

SECTION 10 – CALIFORNIA CONSUMER RIGHTS

California residents waive rights under Civil Code §1542.

CLRA claims require 30 days prior written notice, please contact us to submit your notice.

Nothing limits non-waivable consumer rights.

SECTION 11 – DISPUTE RESOLUTION; BINDING INDIVIDUAL ARBITRATION

PLEASE READ CAREFULLY

11.1 Agreement to Arbitrate

All disputes shall be resolved exclusively through final and binding individual arbitration under the Federal Arbitration Act.

This includes:

  • Product performance claims
  • Injury claims
  • Warranty disputes
  • Consumer protection claims
  • Privacy claims

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.

Unless otherwise required by law, arbitration shall take place in Harris County, Texas, or may be conducted remotely at NomadMat’s discretion.

11.2 Delegation Clause

The arbitrator, and not any court, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.

11.3 Class Action Waiver

YOU WAIVE THE RIGHT TO:

  • Participate in class actions
  • Participate in mass arbitration
  • Bring representative claims

All claims must be individual.

11.4 Mass Arbitration Control

If 25 or more coordinated claims are filed:

  • Claims shall proceed in batches of 10.
  • Remaining claims are stayed.
  • This prevents abusive mass filings.

11.5 Jury Trial Waiver

If arbitration is found unenforceable:

YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

11.6 Small Claims Exception

Individual small claims actions may proceed in small claims courts.

11.7 30-Day Opt-Out

You may opt out of arbitration within 30 days of first purchase by emailing:

Include full legal name and purchase email.

SECTION 12 – INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS NOMADMAT AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL THIRD-PARTY CLAIMS (INCLUDING CLAIMS BROUGHT BY GUESTS, CLIENTS, STUDIO MEMBERS, OR OTHER USERS), LIABILITIES, DAMAGES, LOSSES, JUDGMENTS, SETTLEMENTS, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR RELATING TO:

  • YOUR MISUSE OF PRODUCTS
  • FAILURE TO FOLLOW CARE INSTRUCTIONS
  • IMPROPER PLACEMENT OR UNSAFE USE
  • COMMERCIAL OR STUDIO DEPLOYMENT
  • VIOLATION OF THESE TERMS
  • INJURY TO THIRD PARTIES CAUSED BY YOUR USE
  • YOUR BREACH OF ANY REPRESENTATION OR WARRANTY IN THESE TERMS

NOMADMAT RESERVES THE RIGHT TO ASSUME EXCLUSIVE DEFENSE OF ANY INDEMNIFIABLE CLAIM, AT YOUR EXPENSE WHERE PERMITTED BY LAW.

THIS OBLIGATION SURVIVES TERMINATION OF THESE TERMS.

SECTION 13 – INTELLECTUAL PROPERTY

All content, including text, graphics, logos, images, and product designs, is owned by NomadMat or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.

SECTION 14 – RELATIONSHIP WITH SHOPIFY

NomadMat’s online store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you. However, all sales and purchases made through our store are transactions solely between you and NomadMat.

By using the Services, you acknowledge and agree that Shopify and its affiliates are not responsible for any aspect of any transaction between you and NomadMat, including product performance, injury, damage, refunds, chargebacks, or disputes. To the fullest extent permitted by law, you release Shopify and its affiliates from any claims arising from or relating to your purchases or use of NomadMat products.

SECTION 15 – FORCE MAJEURE

NomadMat is not liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, supply chain disruptions, strikes, wars or other military conflicts, terrorism, pandemics, or government orders.

SECTION 16 – GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. If arbitration does not apply, disputes shall be brought exclusively in the state or federal courts located in Harris County, Texas.

SECTION 17 – SEVERABILITY

If any provision is unenforceable, remaining provisions remain in effect.

If the class action waiver is invalidated, the arbitration provision is void.

SECTION 18 – CHANGES TO TERMS

NomadMat may update these Terms at any time.

Continued use constitutes acceptance of changes.
